TERMS AND CONDITIONS
Any media produced is strictly intended for the client’s professional use only. Client assumes full responsibility and liability for any public performances or display of the video.
The client will receive a final product, any raw unedited footage is solely copyrighted to Interval Films. In an event client would like raw unedited footage, Client will pay for Copyright of footage and will provide Interval Films a HardDrive to receive footage.
Interval Films will exercise reasonable care in providing service and handling Client’s materials. Interval Films shall not be liable for losses due to circumstances beyond our control, including but not limited to power failure, equipment malfunction, defective tape stock, Acts of God, nature, illness, accident, theft, or vandalism. The amount of damages paid to or suffered by the client will be limited to the amount(s) paid to Interval Films (i.e. refund of retainer or total paid to date) and is not to exceed the agreed upon amount of this agreement. Client agrees to forfeit all punitive damages. No other warranty is expressed or implied.
In the event of a cancellation of this agreement by client, client agrees that all fees already paid to Interval Films at the time of cancellation date will be forfeited.
Interval Films will take paramount concern to produce a finished product of excellent quality and makes no guarantees, neither expressed nor implied, in regard to aesthetic qualities of the completed project. Your satisfaction is our primary goal. By checking the agreement box below, you, the client(s), acknowledge that the finished product is a creative work, and as such, reasonable artistic license/discretion will be used in the filming and editing of the resulting video.
Interval Films reserves the right to terminate this agreement for any reason at any time. Should this occur, all monies paid will be refunded.
In the event that Interval Films is unable to perform the services stated herein, Interval Films will make its best efforts to secure the services of an alternate qualified videographer, however the liability of Interval Films in any event shall be limited to the refund of any monies then paid.
All audio and video footage is the copyrighted property of Interval Films. Interval Films reserves the right to use any and/or all footage for promotional, publicizing, exhibition, and/or other exploitation thereof in any manner and by any means and in connection with commercial advertising and publicity tie-ups.
Contracting Party hereby releases, discharges and agrees to hold harmless Interval Films, its heirs, legal representatives, assigns, employees or any persons or corporations acting under permission or authority from Interval Films from and against any and all claims, including but not limited to, liability as a result of any distortion, blurring or alteration, optical illusion or use in composite form, either intentionally or otherwise, that may occur or be produced in the capturing, editing or reproduction of the video.
It is the client’s sole responsibility to inform Interval Films of any specific needs or changes in events.
Delivery of videos will be approximately 1 month after the film date and all pre-production material is received by Interval Films. The completion period is only an approximate length of time and any longer periods necessary for completion will not void this agreement. The Videographer cannot accept responsibility for material lost or damaged in transit.
